1. WHO WE ARE

FillerB, Inc. (“FillerB,” “we,” “us,” or “our”) is a staffing and workforce management platform that facilitates connections between schools, educational institutions, healthcare providers, and credentialed professionals who provide specialized services to children and school-aged populations, including therapists, educators, and healthcare professionals.

2. SCOPE OF THIS PRIVACY POLICY

This Privacy Policy applies to information collected through our website, mobile application, platform, and related services (“Services”). This Policy does not apply to third-party sites or services linked to or integrated with our Services, nor to any information collected offline.

3. TYPES OF INFORMATION WE COLLECT

a. Personal Information You Provide Directly

  • Full name, address, email, phone number
  • Usernames and passwords
  • Professional credentials, certifications, licenses, work history, resumes/CVs
  • Educational background, references, and certifications
  • Employment eligibility, tax documentation, payment information

  • Health and immunization records, medical screenings, TB tests, and vaccination status (where legally permitted or required)
  • Communication history (emails, platform messages, customer service communications)
  • Any additional information voluntarily provided

  • Protected Health Information (“PHI”) subject to HIPAA
  • Health status or vaccination status related to employment requirements
  • Data that may qualify as “sensitive personal information” under state or international law

4. PURPOSES FOR WHICH WE USE INFORMATION

  • To operate, manage, and maintain our Services
  • To match professionals with suitable job placements and assignments
  • To verify identity, credentials, employment eligibility, and background information
  • To comply with legal obligations, including those related to health and safety, licensing, credentialing, and child protection laws
  • To process payments and administer payroll (if applicable)
  • To communicate with users regarding Services, assignments, policies, or legal matters
  • To improve and optimize our platform functionality and user experience
  • For security, fraud prevention, and risk management
  • For legal defense, regulatory compliance, audit obligations, and dispute resolution

5. SMS COMMUNICATIONS OPT-IN AND CONSENT

During signup, you will be given the option to provide your mobile phone number to FillerB.

If you provide your mobile phone number to FillerB, you are opting in to receive SMS messages related to your use of the platform, such as account updates, job notifications, scheduling reminders, and other relevant communications. These messages may be sent through a third-party provider, such as Twilio.

By opting in to receive SMS messages, you give us your express consent to contact you via text using the number you provided. Message and data rates may apply. Message frequency will vary based on your activity.

You may opt out of SMS communications at any time by replying “STOP” to any message or by updating your communication preferences in your account settings. For additional support, reply “HELP” or contact us at hello@fillerb.com.

We will not sell or share your mobile number with third parties for their own marketing purposes without your explicit consent.

6. LEGAL BASES FOR PROCESSING

We rely on various legal bases, including:

  • Performance of a contract or steps necessary to enter into a contract
  • Compliance with legal obligations
  • Protection of vital interests
  • Consent (where required by law)
  • Legitimate business interests, provided such interests are not overridden by individual rights

7. DISCLOSURES OF INFORMATION

We may disclose your information to:

  • Authorized Educational Institutions and Clients to facilitate placement opportunities and staffing services
  • Third-Party Service Providers who provide operational support (including background screening, payroll, credentialing, cloud hosting, analytics, and IT support)
  • Government Authorities and Regulators to comply with applicable legal obligations
  • Healthcare Providers (when applicable to facilitate credentialing or work eligibility)
  • Professional Advisors (legal counsel, accountants, auditors)
  • Successors in Interest in the event of a merger, sale, or transfer of assets

We do not sell your personal information for monetary consideration.

8. PROTECTED HEALTH INFORMATION & HIPAA COMPLIANCE

To the extent we receive, store, or process Protected Health Information (“PHI”) on behalf of covered entities, we comply with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and execute Business Associate Agreements (“BAAs”) where applicable.

Important Clarification: FillerB is not itself a Covered Entity under HIPAA; however, we act as a Business Associate when handling PHI on behalf of healthcare providers, school districts, or government agencies subject to HIPAA.

9. FERPA COMPLIANCE

To the extent we receive educational records from schools or school districts subject to the Family Educational Rights and Privacy Act (“FERPA”), we comply with applicable privacy obligations and process such records solely to fulfill contractual obligations with our educational institution clients.

10. DATA SECURITY

We implement reasonable and appropriate technical, administrative, and physical safeguards to secure personal data, including:

  • Encryption of data at rest and in transit
  • Role-based access control (RBAC)
  • Multi-factor authentication for authorized users
  • Secure cloud hosting environments
  • Regular vulnerability assessments
  • Incident response protocols

However, no method of transmission or storage is completely secure. We cannot guarantee absolute security of your information.

11. DATA RETENTION

We retain personal information as long as necessary to:

  • Provide Services to you or your employer;
  • Comply with applicable legal obligations;
  • Resolve disputes; and
  • Enforce our agreements.

Retention periods may vary based on record type, legal obligations, and applicable statutes of limitations.

12. INTERNATIONAL TRANSFERS

If you access the Services from outside the United States, you consent to the transfer of your personal information to the United States, which may not have the same legal protections for data as your jurisdiction.

13. CHILDREN’S PRIVACY

We do not knowingly collect personal information directly from children under the age of 13. All minor-related information is provided by authorized educational institutions, parents, or legal guardians solely for staffing or compliance purposes.

1. AGREEMENT TO TERMS

These Terms and Conditions (“Terms”) govern your access to and use of the FillerB website, platform, mobile application, and related services (collectively, the “Services”) operated by FillerB, Inc. (“FillerB,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, do not use the Services.

2. USERS & SERVICES

  • Job Seekers/Providers: professionals seeking temporary, part‑time, or full‑time placements in school‑based or healthcare settings.
  • Clients: schools, school districts, educational institutions, and healthcare providers seeking to fill staff vacancies.

FillerB does not itself employ job seekers nor guarantee job placement. All hiring decisions are made solely by Clients.

3. ELIGIBILITY

  • You are at least 18 years old and legally capable of entering into binding agreements.
  • You are authorized to submit any information, documentation, or representations you provide.
  • You will use the Services in compliance with all applicable laws, including but not limited to licensing, credentialing, employment, education, and privacy laws.

4. ACCOUNT REGISTRATION

To access certain features, you must create an account and provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity under your account. You agree to notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

5. USER RESPONSIBILITIES

  • Provide false, misleading, or incomplete information.
  • Misrepresent your qualifications, credentials, or eligibility.
  • Violate the rights of third parties or applicable law.
  • Interfere with the functionality or security of the Services.
  • Use the platform for unauthorized commercial solicitation, spamming, or harassment.

6. CLIENT RESPONSIBILITIES

  • All hiring, employment decisions, and compliance with applicable employment, licensing, and credentialing requirements are their sole responsibility.
  • Background checks, credentialing, and verification processes are performed in compliance with applicable law.
  • Clients are responsible for complying with applicable wage, hour, tax, and employment laws.

7. NO GUARANTEE OF EMPLOYMENT OR PLACEMENT

  • Job placement for Job Seekers.
  • Candidate availability for Clients.
  • Compatibility, suitability, or performance of Job Seekers.
  • Any particular outcome as a result of using the Services.

All employment decisions are made independently by the parties involved.

8. BACKGROUND CHECKS & VERIFICATION

FillerB may, but is not obligated to, facilitate background screening, credential verification, or eligibility checks through third‑party providers. You authorize such checks where applicable, and acknowledge that final responsibility for evaluating candidate qualifications remains with the Client.

9. PRIVACY & DATA SECURITY

Use of the Services is governed by our Privacy Policy. By using the Services, you consent to the collection, use, disclosure, and storage of your information in accordance with the Privacy Policy.

FillerB operates as a Business Associate under HIPAA and as a data processor under applicable privacy regulations, where required by Client agreements.

10. INTELLECTUAL PROPERTY

All content, software, text, graphics, logos, designs, trade names, and trademarks are owned by FillerB or its licensors. You are granted a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services solely for their intended purpose.

You may not:

  • Copy, modify, distribute, sell, or create derivative works from any content.
  • Reverse‑engineer, decompile, or attempt to extract source code.
  • Use the platform to develop competing products or services.

11. DISCLAIMERS

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILLERB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT.
  • ACCURACY, COMPLETENESS, OR RELIABILITY OF PLATFORM CONTENT.
  • UNINTERRUPTED OR ERROR‑FREE AVAILABILITY OF THE SERVICES.

FILLERB IS NOT RESPONSIBLE FOR:

  • EMPLOYMENT DECISIONS MADE BY CLIENTS.
  • THE PERFORMANCE OR CONDUCT OF JOB SEEKERS OR CLIENTS.
  • THIRD‑PARTY SERVICES, INCLUDING BACKGROUND CHECK PROVIDERS.

12. LIMITATION OF LIABILITY

  • FILLERB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
  • FILLERB’S TOTAL LIABILITY TO ANY USER FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID TO FILLERB IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) $500.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FillerB, its officers, directors, employees, contractors, licensors, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising out of or related to:

  • Your use of the Services;
  • Your violation of these Terms;
  • Your violation of any applicable law or rights of a third party;
  • Any employment relationship, claims, or disputes arising between Job Seekers and Clients.

14. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to conflict of law principles.

You agree that any dispute arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in [Insert County/State], and you consent to the personal jurisdiction of such courts.

15. DISPUTE RESOLUTION & ARBITRATION (OPTIONAL)

At FillerB’s sole discretion, we may require you to submit any dispute to binding arbitration under the rules of the American Arbitration Association, conducted in [Insert Location].

16. FORCE MAJEURE

FillerB shall not be responsible for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, government orders, natural disasters, labor disputes, or internet outages.

4. ACCOUNT REGISTRATION

12. LIMITATION OF LIABILITY

16. FORCE MAJEURE

FillerB shall not be responsible for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, government orders, natural disasters, labor disputes, or internet outages.
